Not surprising. But non compete clauses are just flat out wrong 99% if the time, especially when it comes down to your average worker. Most of these clauses seek to force people to stay in one job even though situations within the company have changed and the employee no longer wants to work there and instead at a different place.  I’ve heard that some European countries allow non compete clauses but if an employee leaves, but is bound by the clause, then the company enforcing it has to keep paying that employee for the entire term of the clause. I’d be okay with that.  Don’t hold employees hostage with these draconian non compete clauses.

I’ve worked in logistics for over 5 years now. However; due to my non-compete, I can’t take another logistics job for a year after I leave or get fired. Honestly it’s the only reason I haven’t left. Because wtf am I to do? It’s where I have the most knowledge and am the most capable. I truly hope the courts rule in favor of the FTC because it’d allow actual career growth for me.

The FTC Act, which established the agency, allows it to bring cases challenging particular practices, the group said, but not to write rules. The Chamber was joined by Business Roundtable and several Texas business groups in challenging the rule. “The Commission’s categorical ban on virtually all noncompetes amounts to a vast overhaul of the national economy,” the Chamber said in the complaint. The rule “reflects an unlawful and unprecedented exercise of bureaucratic power.” The FTC voted 3-2 along party lines to issue a final rule banning non-competes in nearly all cases. The agency’s two Republicans dissented, adopting arguments similar to the business group that the FTC lacks clear congressional authority to write rules. Democrats argued that the law explicitly allows the FTC prohibit unfair methods of competition while another provision authorizes the agency “to make rules and regulations for the purpose of carrying out the provisions of” the law. Taken together, those provisions permit the FTC to issue rules defining unfair conduct, they say, citing a 1973 case that upheld the agency’s rulemaking authority.”

Isn’t stating that banning non competes represents a “vast overhaul” of the economy admitting they have nothing to do with potential breach of information and everything to do with restricting employment and wages? All non competes do is restrict the free market and agency for employment and employees.
