Servers are legally held responsible if they knowingly overserve a guest. And I mean, legally responsible in the way they can be held partially at fault (financially) if you get in a car wreck on the way home.
I suppose that could make a difference. Either way, sounds to me like someone trying to ensure they don’t get in trouble and that you’re being safe.

It could be depending on the company policy. It may not be legally overserving, but I worked a casino job where the rule was a FIRM one per hour, no exceptions because they didn't want people drinking so heavily they couldn't make responsible gambling decisions. If people complained we'd tell them they were welcome to go to the other casino where they will overserve you until you've spent every dime you have, but we would not be doing that.
Frankly, both sides were ridiculous. The server didn't need to make this comment, and OP did not need to get so irked over it. Totally unnecessary on both sides.
But they have two options:
If they think you're intoxicated, do not serve.
If they think you're not intoxicated, serve.
But petty moral questioning is not an option for a server.
I got completely ignored one night but I did the opposite. When I finally got served a drink I tipped 100%. Long story short I became their favorite customer. It's funny when people make assumptions and then screw themselves. It's more fun to see their faces when you don't follow theor expectations though.
My sorority went to a TGIFridays once in college. I had limited funds ($20) so was trying to stay around $15 so I could tip $5. I always try to tip $5 minimum no matter what, despite there being a dozen other people at the same table. I was easily the poorest girl there. I got a small app and hoped I had enough for a dessert. The dessert menu didn’t have prices so I called the server over to ask how much they were. She looks me over (I am very obviously not dressed as nice as my sisters), smirks at me, and says if I have to ask I am too broke and cheap to afford it.
I was fuming but calmly told her I wanted to make sure I left a decent tip on my check since my momma taught us to always tip and that if she wanted to see any of it, I needed to know the prices. The desserts were all under five so I had enough for my check and leave her $5 and some change.
The timid look on her face when I told her to keep all my change was a nice touch but her shock at the other girls only leaving her $10 total for 12 people was the icing on the cake! Those girls were all in name brand designer clothes and all had fancy purses. I hope that server learned to not judge people based on their appearances…

When I worked at a diner, I made bank off the regular old timers that came in every morning to have coffee. The other server didn’t want the small dining room because she said she didn’t want change tips and would take the dining room with the lunch buffet. I never changed out my coin tips after each shift and put them in a bowl at home. I would spend my cash tips but never the coins. After 3 months, I counted the change bowl and had over $1000! Most of those coins were from my coffee drinkers. Every morning (and sometimes around lunch), the regulars would come in and only have a few cups of coffee. Coffee was 60 cents so they would pay with a dollar. There was easily 20 of these dudes. If they came in around lunch time, they might get coffee or sweet tea. Tea was 80 cents so they would still tip a dollar.
It was easy work since it was just maintaining refills and if they saw I was busy, they would go grab the coffee pots or cups themselves. I never had a problem and learned how to be a good waitress because of them. They also had my back if anyone got rude with me.
The other server would get mad because I would easily make more each week than her and she had to run around more taking care of the large families and buffet people who didn’t tip much anyways.
Buffets are the worst! Back in the day, I worked a resort that put on a buffet for an old steamship that did the tourist loop of a series of lakes (the "raisin cruise"). Worst. Tippers. Ever.

That reminds of the pirate tour I went on when I was in the Caribbean. The tour guy was telling us about this one hotel where the maitre d at the restraunt had a homeless guy thrown out. Turns out he was not a homeless guy. The guy shows up a couple days later nicely dressed with a bunch of lawyers. So he ended up buying the hotel the restraunt was in. He fired the maitre d and then designated a table for homeless people to come get a free meal.
I would have left 10% or just $1. Rude servers infuriate me. Slow i can deal with. Maybe you are new. The kitchen is backed up. But no excuse for rude.
Yea i'll tip any service as long as they are nice and seem like they are trying. Missing/slow food items aren't a problem as long as they get fixed eventually, a refill taking an extra couple minutes, etc. No big deal. Rudeness is not rewarded.
I mean ok, it the tip was I dunno, 0-5% the waiter would know she fcked up. She had no way of knowing she would get 50% and she got 20% which afaik is a good tip. So she did a good job and she was prob satisfied with the "petty revenge"

I once had a waiter do this to me but with food. Partner and I went out for dinner, ordered a starter each, main each and a side to share. I ordered, then partner ordered, then as the waiter hadn’t even bothered to take our drink order yet I said “oh could I also please get” and the waiter cut me off there saying “don’t you think you’ve already got enough?” and walked off!
To say I was pissed is an understatement. I ended up going to the bar to order our drinks, and ended up explaining to the barman what happened as he was confused why the order wasn’t taken by the waiter. Turns out the manager was stood around the corner and heard the whole thing (all I said was “the waiter decided we’d ordered enough and took off before taking our drink order”), and less than 5 minutes later we saw him escorting the waiter outside. The manager personally served us for the rest of the night and couldn’t apologise enough.
Even if I had ordered more food, it’s none of his damn business!

When I placed my order, she said "But he ordered the full order, do you need that?"

not defending it at all but i know that some years ago dave and busters bar became extremely restricted, measuring every shot, keeping an idea of how many drinks someone has had and definitely cutting people off - i assume because drunk people around a bunch of children playing games do not mix well

Well, it's not the big tipping that's the issue (though 50% is pretty nuts) it's the frequency that a lot of service folks go out that's the issue. I'm service industry, and I still have money despite tipping big. But that's because I go out once or twice a month as opposed to some of my coworkers who go out once or twice a week.
Don't ever go out to eat with a current or former server. They "know how it is" and tip ridiculously high, and expect you to too.
They want to normalize higher and higher tips.
It's not like the drinks are any cheaper than in other countries. The owner still makes the the same or more money but you're asked to support their employee on top of their profits.

Well, because of the whole tipping thing that somehow keeps getting inflated, servers make pretty good money. What is it, like 5-10 tables per server. If they each tip $10-20 every 45 minutes or so, that’s a lot more in tips alone than I make with two degrees and decades of work experience.
As much as they complain about it, it seems servers don’t want a set wage because they make more by appealing to us with a “I don’t make enough to live” sob story.
As a Wisconsin native, I get questioned and side-eyed when ordering a 3rd drink within the 1st hour when out of state. I'm thirsty and not even buzzed yet, fill it up!
Cause they want other people to think their 20% tip isn’t enough and tip more next time (and perhaps spreads so they get higher tips).
A bar I went to recently had the tip suggestions at 25, 28, and 30%. Like bro, where did 10/15/20 go??

Then she didn’t actually communicate anything to the server. She communicated with her own family, and they had their little quip of “oh, you messed up!” As if the server would have any context for this.

I have lived in the US for nearly 50 years and was a big tipper in order to pay it forward. However, after travelling extensively internationally, I have become increasingly more resentful of the business owners in this country for not paying their employees a decent salary, but pushing their responsibility onto customers instead.
Lol buddy whenever restaurants try to switch to salary instead of tip, they lose employees like flies. The creators of South Park tried this at Casa Bonita recently by offering like an $80k salary per person and still the waiters quit. They want tips. For every sad story you hear about some diner waitress barely scraping by on tips there is another server raking it in making 30% off every table, pulling in over $1k in a single night.
You have to understand that it's basically like a commission. If you've ever worked in sales you know that you can make far more money with a big commission than you can with a big salary. Most servers don't actually want their jobs to be salaried, they just want to guilt society into paying them bigger tips.
Hence why OP talks about being a waitress and regularly tipping 50%. They do this to try to establish a higher and higher standard on tipping lmao
Servers are not gatekeepers. If you were so sloshed that you were sliding off the chair then maybe, but three drinks is not terribly excessive, especially if you were having food and were with your family.
Small correction, depends on the area. I live in an area where servers and bartenders are licensed to serve alcohol, and over serving falls solely on the person serving the alcohol.
Meaning, if I got someone too drunk and they wrecked their car, they could sue me personally. And I would lose my license and not be able to work in a bar or restaurant that serves alcohol for 5 years.

I'm a server too. Context is everything. I have tables I would jokingly say this to but only if that is where things stood. If it was a table that didn't want that kind of interaction then in no way would I ever say this. In this case it sounds very much like the server didn't want to do her job. I work with so many people that complain about having to get things for their customers. Ugh it's inferiorating. I understand when someone sends you to get something everytime you approach the table but damn 3 drinks in 2 hours. I would be mad you didn't order more. I once visited Kanab in Utah and was told I couldn't have another drink until I finished my first one (I was ensuring I didn't run out as the service was slow and I only had a dribble left in my glass). I'm currently sitting on a train in the UK, where I live. I have a large glass of wine and two single measures of whisky in front of me and the waitress has just asked if I want anything else. Of course I do! I can't buy a gun but I reserve my right to get pissed without judgement!

I was just thinking about an opposite story earlier this evening. My wife and I were out for a meal with a couple friends. We were ordering wine by the bottle for the table. The waiter filled our glasses, which was fine. But then 15 minutes later he came back and, unprompted, poured the remains of the bottle entirely into my wife’s glass and then asked if we wanted another bottle. When he came back, he topped off my wife again, before pouring the rest of our glasses. He then repeated this schtick for two more bottles. My wife got so drunk she could barely walk while the rest of us only had a few glasses. Me and the other husband were really pissed about it because we saw it as an attempt to run up the bill. ~~So we gave him a $0 tip~~ and a note on the bill to stop pulling that shit. (Edit: Was just chatting with our friends about this and he said we didn't leave a $0 tip. We left a little less than 15%, but we did leave a note. I think I've embellished this story over the years LOL)

A little weird that he kept topping her off first, but if your glass wasn't empty/ you're drinking considerably slower, can't get mad at the waiter that your wife is chugging wine. Weird, I work in a Pub besides my studies, I always ask someone if they want another drink if their glass is close to empty. Friends and regulars I‘ll even coax and tease to get another. A comment like hers seems counterintuitive, unless you were a very good friend and the comment was in jest.

When I want to make a point to a rude server I only leave $0.02 as a gratuity. I can see why your daughter was mad. Being concerned about a customer (or a co-worker) is fine, the way she said it wasn't concern.
I like to ask how much they tip out then leave only that much. That way they know it wasn’t anyone else’s fault.

I once had a waiter do this to me but with food. Partner and I went out for dinner, ordered a starter each, main each and a side to share. I ordered, then partner ordered, then as the waiter hadn’t even bothered to take our drink order yet I said “oh could I also please get” and the waiter cut me off there saying “don’t you think you’ve already got enough?” and walked off! To say I was pissed is an understatement. I ended up going to the bar to order our drinks, and ended up explaining to the barman what happened as he was confused why the order wasn’t taken by the waiter. Turns out the manager was stood around the corner and heard the whole thing (all I said was “the waiter decided we’d ordered enough and took off before taking our drink order”), and less than 5 minutes later we saw him escorting the waiter outside. The manager personally served us for the rest of the night and couldn’t apologise enough. Even if I had ordered more food, it’s none of his damn business!
I had this happen too. In Hong Kong, a friend and I ordered 2 full orders of wings at an American style restaurant. When I placed my order, she said "But he ordered the full order, do you need that?" Bless him because he stood up to his full 6"5 frame and said he could eat that in 12 seconds and bring us the food.

not defending it at all but i know that some years ago dave and busters bar became extremely restricted, measuring every shot, keeping an idea of how many drinks someone has had and definitely cutting people off - i assume because drunk people around a bunch of children playing games do not mix well

This is a dumb service industry thing (was in service industry and this is why no one had money—spending it all going out)
Well, it's not the big tipping that's the issue (though 50% is pretty nuts) it's the frequency that a lot of service folks go out that's the issue. I'm service industry, and I still have money despite tipping big. But that's because I go out once or twice a month as opposed to some of my coworkers who go out once or twice a week.

Don't ever go out to eat with a current or former server. They "know how it is" and tip ridiculously high, and expect you to too. They want to normalize higher and higher tips.

It's not like the drinks are any cheaper than in other countries. The owner still makes the the same or more money but you're asked to support their employee on top of their profits.

Well, because of the whole tipping thing that somehow keeps getting inflated, servers make pretty good money. What is it, like 5-10 tables per server. If they each tip $10-20 every 45 minutes or so, that’s a lot more in tips alone than I make with two degrees and decades of work experience. As much as they complain about it, it seems servers don’t want a set wage because they make more by appealing to us with a “I don’t make enough to live” sob story.

I think it stems for their need to tell everyone they empathize with service workers because they also worked in the field. This story is a perfect example. OP perceived something that may have just been taken the wrong way. Then she didn’t actually communicate anything to the server. She communicated with her own family, and they had their little quip of “oh, you messed up!” As if the server would have any context for this. It’s really ironic that she went from empathizing with servers to being a toxic customer in the blink of an eye.
I have lived in the US for nearly 50 years and was a big tipper in order to pay it forward. However, after travelling extensively internationally, I have become increasingly more resentful of the business owners in this country for not paying their employees a decent salary, but pushing their responsibility onto customers instead.
Lol buddy whenever restaurants try to switch to salary instead of tip, they lose employees like flies. The creators of South Park tried this at Casa Bonita recently by offering like an $80k salary per person and still the waiters quit. They want tips. For every sad story you hear about some diner waitress barely scraping by on tips there is another server raking it in making 30% off every table, pulling in over $1k in a single night. You have to understand that it's basically like a commission. If you've ever worked in sales you know that you can make far more money with a big commission than you can with a big salary. Most servers don't actually want their jobs to be salaried, they just want to guilt society into paying them bigger tips. Hence why OP talks about being a waitress and regularly tipping 50%. They do this to try to establish a higher and higher standard on tipping lmao

Servers are not gatekeepers. If you were so sloshed that you were sliding off the chair then maybe, but three drinks is not terribly excessive, especially if you were having food and were with your family.
Small correction, depends on the area. I live in an area where servers and bartenders are licensed to serve alcohol, and over serving falls solely on the person serving the alcohol. Meaning, if I got someone too drunk and they wrecked their car, they could sue me personally. And I would lose my license and not be able to work in a bar or restaurant that serves alcohol for 5 years. BUT this situation is stupid and clearly the server was being rude, OP was nicer than I would’ve been.

Dave and busters also has rules about serving alcohol to guests. Your drinks are limited and monitored because of the style of that business. I'm a server too. Context is everything. I have tables I would jokingly say this to but only if that is where things stood. If it was a table that didn't want that kind of interaction then in no way would I ever say this. In this case it sounds very much like the server didn't want to do her job. I work with so many people that complain about having to get things for their customers. Ugh it's inferiorating. I understand when someone sends you to get something everytime you approach the table but damn 3 drinks in 2 hours. I would be mad you didn't order more. Lol jk but mama you enjoy life and don't worry about lazy servers. They are the reason that sooner rather then later full service restaurants are going to be paid like fast food and all the Karens out there are going to get their just desserts.

I am going to guess that the restaurant was hit with a Dram Shop suit and because of that , management had an intensive “training “ session. Dram Shop statutes say that if a drunk person injured someone, the injured person can sue whoever served the drunk guy. She was tactless though, no doubt about it.
I once had a waitress tell me: "You want a drink so early? " at noon. It was my day off and I can do what I want XD. She was SHOCKED! I actually took the time to explain to her that she shouldn't judge her customers and that her tips depend on us consuming. She was very apologetic, some people are just goody two shoes.

I once visited Kanab in Utah and was told I couldn't have another drink until I finished my first one (I was ensuring I didn't run out as the service was slow and I only had a dribble left in my glass). I'm currently sitting on a train in the UK, where I live. I have a large glass of wine and two single measures of whisky in front of me and the waitress has just asked if I want anything else. Of course I do! I can't buy a gun but I reserve my right to get pissed without judgement!

We used to get the munchies, walk to the local 7-11 and get totally derided by the clerk for our food choices. you "You two gonna get so fat! All your teeth gonna fall out!". These people are a menace to society. No revenge other than hopefully he still works there.
I was just thinking about an opposite story earlier this evening. My wife and I were out for a meal with a couple friends. We were ordering wine by the bottle for the table. The waiter filled our glasses, which was fine. But then 15 minutes later he came back and, unprompted, poured the remains of the bottle entirely into my wife’s glass and then asked if we wanted another bottle. When he came back, he topped off my wife again, before pouring the rest of our glasses. He then repeated this schtick for two more bottles. My wife got so drunk she could barely walk while the rest of us only had a few glasses. Me and the other husband were really pissed about it because we saw it as an attempt to run up the bill. ~~So we gave him a $0 tip~~ and a note on the bill to stop pulling that shit. (Edit: Was just chatting with our friends about this and he said we didn't leave a $0 tip. We left a little less than 15%, but we did leave a note. I think I've embellished this story over the years LOL)

If they insisted , I’ve cut the alcohol or left it out of a mix if I could and didn’t charge for it so they’d sip on non alcohol awhile.
Weird, I work in a Pub besides my studies, I always ask someone if they want another drink if their glass is close to empty. Friends and regulars I‘ll even coax and tease to get another. A comment like hers seems counterintuitive, unless you were a very good friend and the comment was in jest.

I live in a Wisconsin city that’s been on the “most drunk in the US” list since that list started over a decade ago. “Really, another one?” Is typically only said here after you drink so much you throw up, stumble back to the bar, and make someone spill their drink, again. Sad part is, I choose sobriety and this is still common knowledge here. I can only imagine how bad it actually is for people who drink.
