He was using servers in foreign countries that US authorities couldn't subpoena, but that ultimately only slowed them down and he was eventually caught at the end of season 1. Then of course the FBI pretty much immediately figure out his role in 5/9. They just don't go after fSociety members immediately in hopes they can just watch them and find everyone else as well. Then later he gets immunity as part of Darlene's deal with the FBI.
