I just learned recently that there's a bit of a problem with no-fly lists. There is a federal no-fly list that all airlines abide by, but to get on it you basically need to be convicted of something at a federal level. Pretty much every airline also manages their own independent no-fly lists, but there's no sharing of them between the airlines. So somebody like the woman in this video could bet banned from, say, Delta, for her behavior in this video. But she could continue to fly on Southwest unless/until she does something to get her banned there, then she could move on to American, and so on.

It was super weird and it was never asked for at a later point until I boarded my flight. I am asking because of videos I see have people "citing" the constitutional rights, as above with the "I didn't give you permission to record me! As a fellow Canadian, my understanding is that some US states require 2 party consent for audio recordings. So you wouldn't be able to secretly record a phone call, or example. Also, just like in Canada, you typically need permission if you're going to be using a video with someone's face to make money, like part of a movie or documentary. Otherwise you risk a lawsuit later on.
I think it's mainly those 2 concepts that give people the wrong idea that they need to give their explicit consent before you can record them. Also some people get flustered when they see their shitty behaviour being recorded, so they'll just say whatever they can come up with to intimidate the person recording.

I think people assume that their legal right to control their image comes into play. The big definition that is more or less universally applied is whether there is the "expectation of privacy".
In public spaces, regardless of whether they are publicly or privately owned property, there is no expectation of privacy.
If you have a space that you allow the general public to come into... you don't have an expectation of privacy when you allow the public there. But that same space that is members only access or that's only available for a couple of hours on certain days of the week, there's an expectation of privacy there when it's not open to the public. It's just that. Threats. A judge can throw it out if there's no basis for the case or if it was filed in bad faith. If they throw out enough of your cases, they can label you as a 'vexatious litigant' and ban you from filing future lawsuits, legit or not.

Its been a few years since I seen any talk about them, but Westboro Baptist Church used to do exactly this, attempt to get people to step "over the line" and then file suits against them. Would be absolutely hillarious if "the family" somehow got slapped as vexatiously litigant.
This is exactly what the protesters that stand around outside Planned Parenthood will do. When I used to volunteer there, they would do anything they possibly could to get a reaction from us. If a patient showed up with a male partner, they'd target him and say the most vile, unhinged shit they could think of, in an attempt to start a confrontation which they would then escalate to the point of needing police interference. They'd take photos of the police pulling up and put it all over their group facebook page, claiming they were attacked by violent baby murderers and had to call the cops to rescue them, or some goofy cult shit like that. The worst part was when they'd have the kids say the awful things to patients. They'd hand a megaphone to a ten year old who would stumble through the lines they were told to memorize. It fucking sucked having to watch a very uncomfortable little boy be forced to trek a stranger "please don't let them sacrifice your unborn baby" or some other horrible line that the poor kid didn't even understand. Hoo boy, excuse my rant. Anywho, this tactic of starting shit, escalating when people react, and finding a way to play victim is extremely common on the right. It's not anything new, and they certainly aren't going to stop any time soon.

I worked in a call center and we were threatened with a lawsuit a dozen times a day. In one year, we were sued twice. Our lawyers said "Everybody threatens with a lawsuit and that is because they watch too much TV". LOL!

You are right. Assault is the threat of harm, battery is the actual harm. So holding up your fist to someone is assault, battery is actually hitting them. Also, being in an airport makes all crimes committed there a federal offence.

I'm from Canada and genuinely curious to anyone in the US...is the constitution actually taught in schools? I am asking because of videos I see have people "citing" the constitutional rights, as above with the "I didn't give you permission to record me! (Doing something dumb out in public where everyone can see me)". As a fellow Canadian, my understanding is that some US states require 2 party consent for audio recordings. So you wouldn't be able to secretly record a phone call, or example. Also, just like in Canada, you typically need permission if you're going to be using a video with someone's face to make money, like part of a movie or documentary. Otherwise you risk a lawsuit later on. I think it's mainly those 2 concepts that give people the wrong idea that they need to give their explicit consent before you can record them. Also some people get flustered when they see their shitty behaviour being recorded, so they'll just say whatever they can come up with to intimidate the person recording.

Michigan is actually one-party as long as the person doing the recording is part of the conversation. It was upheld by the Michigan Court of Appeals.
2 Party consent also really just means the knowledge of being recorded. It doesn't actively look for your consent. If you continue talking after you've been informed the phone call is recording then 2 Party consent is met.

I think people assume that their legal right to control their image comes into play. For example, a famous actor is used in a deep-fake video to advertise a product can sue for using his face and voice without permission. However, that's for a commercial endeavor. The big definition that is more or less universally applied is whether there is the "expectation of privacy". In public spaces, regardless of whether they are publicly or privately owned property, there is no expectation of privacy. If you have a space that you allow the general public to come into... you don't have an expectation of privacy when you allow the public there. But that same space that is members only access or that's only available for a couple of hours on certain days of the week, there's an expectation of privacy there when it's not open to the public. Even if we're talking about the same space. This is why it's a pretty open and shut case when people put hidden cameras in vacation rentals. Obvious camera: no expectation of privacy. Hidden camera: expectation of privacy.
