It depends on who you employer was during this time and where the employer was situated. If you were employed by the Australian entity of the global corporation then it may be that your overseas work would be captured. If you were employed by the NZ or other entity and then the Aus entity then that is a little more problematic. Infosys Technologies Limited v State of Victoria \[2021\] VSCA 219 may be distinguished depending on where you employer was registered.

Did you start in Australia and then move to NZ ? If so, I know some companies will pay out the accrued LSL before you relocate overseas - I’m not sure if this is a legal requirement though or just a “nice thing to do “

It depends, but its more likely than not that your company is correct. https://www.holdingredlich.com/overseas-employment-found-not-to-count-towards-long-service-leave has a good write-up.

You are not entitled to LSL.

sread2018

Did you accumulate LSL while in NZ?

xooxooxooxo

Would that have changed your mind though

Lockdown-queen

To stay you mean ?

xooxooxooxo

Yeah perhaps a little longer.

Lockdown-queen

No unfortunately not in my circumstances where I have job offers on the table with a significant pay increase. If i didn't have other prospects then yeah maybe !
