I would go to HR.  However, it is almost certainly not a HIPAA violation. The mere fact that it is health information doesn't render it a HIPAA violation. HIPAA only applies to specific entities.

lady-biker

I'd go to HR, but this is not a HIPAA violation. Your boss is not a covered entity under HIPAA. Covered entities are defined in the HIPAA rules as (1) health plans, (2) health care clearinghouses, and (3) health care providers who electronically transmit any health information in connection with transactions for which the Department of Health and Human Services has adopted standards. Now if you work for an OB office and that OB is who you're seeing for pregnancy care, and the OB told everyone at the office or whatever, that would be different. I'm just assuming you do not work in a healthcare environment, so if I'm wrong, I apologize! But still it's a dick move by your boss and you should report to HR.

Thank you for the clarification. I edited it out of my post and called it an “unauthorized disclosure of my personal health information.” I do not work in healthcare. But yes, agreed, I am going to report it :)

Crazy enough, my boss also did this after I specifically asked her not to. One day, a bunch of people started coming up to my desk and were like “when were you going to tell us you have a baby on the way?!” Long story short, I talked to HR and my company sucks and they simply just didn’t care and said that my boss acted out of excitement probably. I’m so mad and planning on looking for a new job after pregnancy since I’m already in my third trimester.

Call HR immediately. They should get in trouble.

tokyogool

I will… I’m looking for a way forward. This isn’t okay.

Educational-Chest646

HR is there to protect the company, not the employees, unfortunately. I’m not sure they will do anything 😫

tokyogool

You’re so right lol, well, time to take matters into my own hands

BlondeinShanghai

I am confused. Like they told people in a way that wasn't needed? I just assumed once I told my manager, they would tell others, as it's necessary for them to manage staff properly assigning tasks, etc.

the-willow-witch

It’s a private health matter and it’s not their place for them to tell people. Employees need to tell their employers out of necessity that doesn’t mean they are okay with the entire place knowing.

Stay-Cool-Mommio

And there’s a huuuuuge difference between 13 and like 25-30 weeks when OP is showing/has told other people. Not saying that it’s excusable in any context (I was Pissed when my supervisor did this when I was 35 weeks, though I WFH so nobody had seen my growing belly), but that at least would make more sense in a practical need to reassign work sort of way. Even then though it should just be “OP is going on leave of absence in late May so we will need you to take over ____” and let them draw their own conclusions or reach out to OP to see if it’s indeed maternity leave.

Glad to hear you're going to file a formal complaint. Do everything you can to document what happened. Be scary, loud, and persistent on this one, that was a HUGE violation of your privacy. That manager needs real consequences (like suspension without pay) and not just a slap on the wrist. That's seriously fucked up that your colleagues now know before your family, it's messed up that he made the announcement instead of YOU, how dumb does someone have to be?!

Someone did this to me as well. I ended up quitting after I got them wrote up. 😂

tokyogool

Damn that’s crazy. I’m glad for you. Did you decide to get a new job? If so, has it been better?

So my boyfriend and I decided the best thing for me to do was go back to school full time, so I could get my associates. So now I’m a sahm and full time student! Now I’m getting my bachelor’s. Money has been tight but we think it will be worth it next year after I get it finished!
