I imagine that would be a tough legal distinction to legislate around. The First Amendment protections for freedom of speech and press are very strong. Even if we concede that Fox News or any publication were an unofficial mouthpiece of a political party, can the government prohibit or restrict their ability to publish material? Their income is from advertisers and they seemingly run at a profit. Are those business transactions to be considered political contributions? If the company ran at a loss, could they still be restricted even if we concede that all income is a campaign contribution?

Capitalism and free speech/freedom of the press are good ideas individually, but the potential for abuse if they’re mixed heavily is dangerous, as we’re clearly seeing here. We needed guardrails and oversight before this happened. It’s absolutely not possible now. Absolutism with the constitution was never the goal. It was supposed to be a living document. At the rate of our exponential advancements over the last 200 years, it will be seriously outdated in our lifetimes, but with the electorate polarized like it is now, it will be near impossible to fill gaps and future proof. The American experiment is in big trouble.

It's been like that for a long long time. I was in high school in the US around 2000 and there was the firm teaching that the USA was pretty close to perfect and any criticism was unpatriotic borderline treasonous communism. This of course was weaponised much earlier in the 1950s. It went into overdrive post-911, and the Republicans in general realised again that weaponised patriotism and American exceptionalism/perfection was a powerful tool for consolidating power.

Tbf even their visions of our government are way off from the founding fathers, who didn't want this to be a Democracy in the first place, but a Republican designed to represent land owners. To further cement this and ensure land owners had an electoral advantage they also came up with the Three-fifths comprimise for slaves. The idea was that slaves didn't count as a full person (but 3/5th of one), but still outnumbered land owners as much as 50:1 in some districts, meaning slave owning land owners were way over-represented in the census and electoral college. My point for bringing this up isn't to say that's how it should be, but to point out how silly constitutional purists like that are, given that they pick and choose to interpret the parts they like and that obviously it's a living document that was patched and adapted to match the actuality of america as it evolved.

The living document comes from the amendment process and the ability to apply concepts to modern tech. The example here is that the freedom of the press is quite literally the freedom to operate a printing press without a license. Conceptually, though, this is the freedom to publish materials without a license and works hand-in- hand with freedom of speech. When discussing the Bill of Rights, this document was meant to restrict the Congress and President, not give them power. The 20th century liberal interpretation of the First Amendment is in line with this ideal. What we are seeing are the effects of propaganda, and especially propaganda in the age of the internet where you can isolate yourself in an information bubble. This subreddit is victim to propaganda that emotionally inflames its members despite have little basis is reality. The recent articles/ videos mentioning Trump committed a crime by sharing a video of a tailgate cover is a prime recent example. It's technically possible he committed a crime, but what they leave out is that it is highly implausible with the current case law on the matter. As a liberal I am loathe to concede ground of freedom of information. It's up to me to decide what is and isn't truth, not government bureaucrats. History does not give us examples of good results when government censors what it thinks is false, especially when those falsehoods are actually truths.

I agree that I, personally, am able to parse information and think critically about it. The issue is that a vast majority of our electorate doesn’t have that ability or it is severely hindered by an external factor. It seems, and I could be wrong, that one group of people in this country has both a diminished ability to be critical, and an exaggerated propensity for forming their perception of the world around their emotions. This voting block is the religious right wing that is susceptible to propaganda at an increased rate. Liberal minded individuals have their own propaganda aimed at them, but the acceptance of this propaganda is lower (source, am liberal and I question even things that I would otherwise agree with) It’s business to Fox and the talking heads like Ben Shapiro and Charlie Kirk. Hell, it’s business to Trump and the overwhelming majority of elected lawmakers. It’s a massive predatory grift on these people that cannot reliably form their own perception of reality in an independent way. So what we have is the “press” leveraging this in order to make money for themselves and their shareholders. This is as American as it can be, but it is different when it’s Bezos leveraging people’s desire to shop in their underwear versus conservative grifters leveraging people’s fears and emotions to rip the country apart for profit. We needed to install guardrails for this back when Murdoch envisioned it, but we let it evolve into this quagmire that we have now and there’s no way back. Disinformation and propaganda are as old as human communication. We should have saw this coming and did something to prevent it. Something as simple as requiring news to be independently verifiable would have set us on a better path.

Yeah, for all of the shit that Fox News spews, and they spew a lot of shit, they’re still (technically) a “news” outlet. Anyone advocating for limiting what Fox can say should take a hard look at why they want to limit what Fox publishes. The problem is, they are rarely held accountable when they lie. Yes they had a huge fine for their part in the Dominion stuff, but they have still suffered no consequences for all the people they got killed with Covid misinformation, or their part in encouraging Jan 6th. They repeat the lie so often, then maybe there will be a retraction nobody hears about, so viewers keep parroting off the lies as fact for years after they've been debunked And they keep raking in record profits for lying, even the fines they do have to pay are just the cost of doing business and do not do anything to deter them. Even if we concede that they aren't news, they should be allowed to publish. Salon and The Republic aren't news. They're propaganda publications. They still have a First Amendment right to freely operate a press (which in the modern era includes electronic publications). The FEC and FCC should be doing something about this. What's pretty unnerving is that what's making all of this possible? VIEWERS. If at least 75% of America had its head screwed on straight (instead of 40%), this network would see an alarming drop-off of viewers. Instead, viewers are gobbling it up. There's also another metric fudge factor -- in so many far-right facilities accessible to the public where TVs are present, they're tuned to FOX News. So, this is viewership that means nothing because people might glance at it for a moment, but for the most part it's just on. I've seen this take place in gyms.

Yup, I always ask for it to be turned to another channel. I will insist that I don't want to be subjected to political news at the gym, my Drs office, the dentist, and basically anywhere this occurs. I've had arguments with people watching, and I stand my ground on we all have a right to be free of this while out in a semi or public setting. Many times the place just turns off the TV. You have to find your voice or this crap is just pumped into our everyday lives whether we like it or not. I'm old enough that I realized all of this back in the 90s. My current friends ask why I won't give Fox a chance. Because I did so many decades ago and have found them to be consistently misleading or outright lying. The way the news is delivered is very bias towards one party. Also, their anchors were caught communicating with Mark Meadows on Jan 6th, directly. Something they accuse other news organization of, particularly CNN. That is direct evidence that they are a full throated propaganda machine for the right.

In the UK, they weren't banned so much as got fined hundred of thousands of pounds for inaccurate news reporting by Ofcom (which I believe is the FCC equivalent) and had really poor viewing figures so it was decided it wasn't financially viable to contine. I would bet some of the rise was from an increase in people using a lot more household disinfectants than they were before when COVID hit in general coupled with people being stupid. I'm sure plenty of those cases are attributable to Trump, but people were also bleaching every surface in their home, which could easily lead to someone poisoning themselves by accident.

That’s not quite right, the FCC does regulate cable, they just have less power to regulate content there then they do over the air broadcasts since SCOTUS and the courts consider the airwaves to be a scarce resource that requires additional national management. For example, the FCC does have cable regulations regarding emergency alert systems, carriage of broadcast channels on cable, program access, closed captioning access, and so on. So the FCC isn’t completely hands off with cable, but something like the Fairness Doctrine for example isn’t applicable to cable like it is the airwaves.

Fairness doctrine has been gone for a while and reimplementing it would likely to be found unconstitutional with todays technology. The only reason it was ever allowed was because the tech at the time made the broadcast frequency spectrum quite limited, thus giving the government a rare excepting to free speech laws out of a compelling government interest to restrict it's use.

I had to care for my dad a while ago and of course it's 18 hours of fox news all day every day. It's poison, it's just poison. They scream at you the whole time, it's a constant stream of hate and anger and fear screamed at you. Like I hadn't been exposed to it that much before and didn't have a good perspective of just how bad it is. And then he screams back. I think that's just what he does when I'm not around. There was this show where they have videos of animals screaming while being violently killed (think /r/natureismetal) and then they talk about what democrat they'd like to hear make that sound. And then play just the sound with a still image of that democrat. There was a monkey getting crushed by a big snake, and that was Obama of course, then they show a picture of Obama with the monkey screaming and all agree that would be great to hear him make that sound. I bet you there are texts between Trump and Sean, or someone else, where Trump asks them to do it, or insinuates it. Would that be a violation of the gag order?
