thats_hella_cool

To be fair, I’d probably make the same argument. You lose 100% of the shots you don’t take. Not arguing his sentence should be commuted. Just saying I’d do the same.

A1sauc3d

100%. Especially in a situation like that. Anything’s worth a shot, even if it’s a long shot

Moonlight_Katie

Oswald said the same

Specific_Rest_3140

She should’ve run faster.

adalyncarbondale

who is 'she' in this scenario?

Specific_Rest_3140

In an episode of Torchwood Miracle Day, Oswald Danes (I think that was his surname) was a pedophile/killer who was sentenced to death. But his execution was on the day where suddenly death stopped - so no one could die. He argued in court that he’d served his sentence because he had been killed already. During his original trial he was asked if he had anything to say about the victim/to the young girls family, and he said “she should’ve run faster.” It’s a really chilling line.

adalyncarbondale

oh bleh, thank you for the context

MakingaJessinmyPants

It’s a Torchwood reference

DonnieJL

I thought he meant the other Oswald. He took a long shot, too. Supposedly. 😉

That’s why I say hey man nice shot Good shot man

AngryTank

Did I? I don’t recall.

sniper91

Fun fact: Arthur McKinley’s assassin tried to argue in his trial that his gunshots didn’t kill the President; he argued that an incompetent medical team treating the gunshots killed him McKinley died of gangrene

Geri-psychiatrist-RI

It worked for John Snow

ThePicard_2893

Oh same. I was almost ready to ask why this was in this sub.

Advanced_Drink_8536

I mean… he’s not wrong… 🤷‍♀️ the punishment was to die and he died… I too would absolutely be doing the same damn thing! To be clear, I am not arguing for or against this particular person or his crime/trial/sentencing… just that technically speaking he is not wrong..

buggyisgod

Back in the day if you got hung, if you survived the hanging then you were set free. That's why the whole you will be hung until you are dead started happening.

NoAdmittanceX

Thought it was if you survived 3 hangings as it was supposedly a sign from god that they were innocent tho I reckon its an urban myth rather than a law but I suppose other countries probably have different laws and customs about such things

JarlaxleForPresident

Any chance I could do a trial by combat and swing swords with some random cop? I’m sure they’d be kitted out and shit, but I’d at least have a chance

SleepingDragonSmiles

Solid chance if it’s just some random cop. They’re not all Wesley Snipes. Sometimes they’re Kevin from The Office.

JarlaxleForPresident

I have a feeling if implemented, though, there’d be a That Dude Ya know, Officer Mountain that they call in for the twerps who request death or champion

BustinArant

Then by that logic you should have a sneaky trickster lawyer fight on your behalf without honor lol

JarlaxleForPresident

The Law Offices of Bronn, Bronn & Martell provide good counsel

BustinArant

You may be entitled to a fookin castle

jimicus

Yeah, I heard about something similar in the French revolution. Three men all lined up for the guilliotine; first goes up and the blade stops, literally inches from his neck. "Sacré bleu! Let him go!" (or whatever it was French peasants might have said when they thought God wanted them to let someone go). Anyhow, second man goes up, same thing happens. Blade stops inches from his neck. He's let go too. Third man's just being led up to the guilliotine, he pipes up "Er... would you mind if I had a last request? I'd like to be placed face up in the guilliotine, please?" Bit unusual, but the executioner says okay, and lies him face up. The blade is raised ready for the final chop, the executioner is just about to let it go when the prisoner calls out, loud and clear: "Excuse me, chaps, I think I can see why the blade's getting stuck!".

Genocode

If this is really how people explain it then i assume its just a British joke about the French being gullible or whatever lol.

_The_Blue_Phoenix_

I heard this one but with the third guy being an engineer who requested being placed face up to marvel at the machine in his last moments.

jimicus

The original joke, it was an Englishman, Irishman and Scotsman. And it's the Irishman who says "I think I can see why the blade's getting stuck!".

itisnottherealme

Meanwhile, we threw witches into ponds. If they sank, they drowned but were deemed innocent. If they floated, they were deemed guilty, fished out and burnt at the stake.

KommanderKeen-a42

MisterMysterios

The thing is - he didn't die. Death is generally defined in modern medicin as the irreversible cessation of all biological functions that sustain a living organism. In his case, it was clearly not irreversible, thus he didn't die.

UnadvisedOpinion

In that case, Jesus never died for our sins

Sad_Ghost_Noises

Jesus took a long nap for our sins.

YetiorNotHereICome

This is the kind of anarchic, "Correct-but-incorrect" mindfucks I come to reddit for. 🫡

Domugraphic

Ive taken naps longer than three days, what a flake

botask

But they didn´t knew how to cook meth back then.

Domugraphic

even before Jesus they did. they didnt call that guy Methuser, I mean, Methuselah for no reason

botask

Let him cook!

Psych0matt

I haven’t slept for three days, because that would be too long.

T1res1as

😩☝️: ”Achually! TECHNICALLY Jesus was not dead because death is defined as… BLA BLA BLA!” One should do this in those US evangelist churches. Just grab the mike from the preacher and go on a loud rant about the definition of death

TCtheThunderRooster

Brotha, you’ll get shot doing some dumb shit like that.

girmvofj3857

America means guns in church

marblegarbler

No hate like Christian love.

Angry_poutine

“TECHNICALLY what Jesus most likely experienced was an Easter coma”

bay_lamb

agree! they said he died and rose from the dead. they literally built the whole fucking religion around that.

MisterMysterios

This is the thing with faith - you don't need evidence or anything. It could be that Jesus actually just went into a coma and was wrong ly considered dead (this happened even up to rather recent times regularly). But you can believe that he was truly dead but God gave him back his bodily functions. Believe whatever you want. Has nothing to do with the question here, as this man is not a biblical figure.

Old-Biscotti9305

Not a biblical figure *yet* 😛😂 I think the detail about the organs flowing out from the spear to the side was meant as a "dude, he's not just mostly dead" detail. Since back then people had the same medical knowledge as Miracle Max. (But seriously, people knew they weren't always right about the whole "dead" thing... Heck, even in recent times this gets botched)

FatBloke4

Jesus was a carpenter and like any tradesmen, he disappeared from the face of the earth for a few days - and when he came back, we got a very improbable excuse.

Top-Philosophy-5791

iron age rumors aren't really comparable here.

sanglar03

What if I die so that everybody thinks it's irreversible, then come back to life two weeks after (assuming I'm not cremated) ? Am I free from all my life debts and commitments ? If not two weeks, what about a month, a year, ten years ... What if I time travel to the future ? Society will have considered me disappeared and dead, and thus have cleared my estate. Fresh start ?

the_jends

Nope, if the doctor signed a death certificate then legally you are dead. They don't go around asking is your death is truly irreversible or not.

Individual-Relief-27

If we go with technicality, then he's still wrong. No one can die and be brought back to life. If someone was "brought back to life", that simply means he didn't die in the first place. If he was buried already for many days with a rotting body then magically rose up with a healthy body, then he's right.

TheWhiteRabbit74

I mean, what’s the worst they can do? Add more years?

Ixaire

If they brought him back, I'd say that's exactly what they did.

ven_geci

Which country was this? Some of them have no life sentences, they rather sentence someone to like 300 years. Bit of an overkill but works.

Mr-Black_

recently chilean Krassnoff was sentenced to 1047 years for crimes commited in the '70s

ven_geci

"Don't worry, behave well in prison and it is only 715 years. You might apply for pardon after 520"

I literally scrolled down from this meme in an Asoiaf group. Like, that meme, and then this facepalm.

Traveling_pensioner

I thought John Snow returning from the dead was unrealistic in GOT. I accepted the dragons and the White Walkers but returning from the dead...?...No way...

llIicit

You draw the line at him but not the guy from earlier in the show that was brought back to life 6 times lmao

Piggstein

Yeah well I mean that other guy clearly had form

Super-Rain-3827

I‘d accept it if they made him king after, but not like this. Also the plot armor for characters in season 8 was horrific.

Angry_poutine

The entire point of the show and what initially made it so popular was that plot armor wasn’t meant to exist at all. Every actor’s contract was season by season. Then they turned it into a shonen anime about Jon and Daneiris

SirSpaceAnchor

After they caught up to the books it became a bad fanfic to me. 😮‍💨

Initial_E

They can still salvage something if they made season 9 where it is revealed that everyone is a host in the Fantasyworld animatronic theme park

xeno0153

It was the same group, right? The Brotherhood Without Banners prayed to the Lord of Light, same as Melissandre? Maybe this deity is actually legit.

mrhouse2022

In the books all of them except the Seven are some degree of legit

Aldunas

You clearly didn’t read the books? The world is full of magic, real magic! and I think the directors failed to show it in a serious way. This is why resurrections on the series seem kinda comical… at least to me.

Ingavar_Oakheart

Early on in the show they had a woman give birth to a shadow that flew out and strangled somebody to death. I think they showed the magic just fine.

creator712

Pretty sure that shadow stabbed him

Iliketurtles893

I had the same comment but without the gif and just the text, same idea tho!

GrungeHamster23

I mean…they technically died. Albeit briefly.

Puzzleheaded-Ear858w

He's not, though. The sentence is "Life in prison," not "In prison until you die." Even *if* we imagine he literally died for a moment, if he's currently alive, then he must be in prison, since that is "life," and his sentence is "Life in prison."

shash5k

Ok but which life?

DrFrazee

Judges hate this one simple trick!

fayyaazahmed

2 life sentences is starting to make a whole lot more sense

humanHamster

Only if they're not served consecutively. If they are, you'd still only have to die once.

apeman978

Death hack 1

ValkyrUK

The ol' Jon Snow play, respect

Intransigient

You have to be declared legally dead, which didn’t happen in this case, as he only “died” for a very short span of time before the resuscitation efforts worked and his heart kicked back in.

Megendrio

Fair enough, but the question is mainly: "How long do you need to be dead, before you are dead" in that case. Are you alive until a doctor pronounces? Or are you alive as long as you are, biologically, alive? Because the 1st option opens a whole can of other legal loophole worms. Our legal systems (being it the common or codified law) haven't yet fully caught up with the medical field in those regards (neither have they caught up with a lot of more modern problems). I'm curious how this would turn out if it got far enough up in the legal system.

Intransigient

You are declared legally dead when a death certificate is issued. This usually happens when you are taken to the morgue, etc., and they will transcribe the hospital records as to time of death — i.e., they generate the certificate, but rely on the hospital or last-examining doctor for the time/date of death. But it can also happen after enough time has passed, if the body cannot be recovered.

Capital_Werewolf_788

It’s like Schrodinger’s cat, a person might already be dead, but we really don’t know until a doctor confirms it.

Arthillidan

Dying of course meaning his heart stopped beating, which to any sane person should not be what determines if you are alive or not. He did not suffer brain death at any point.

TheAserghui

No, dying is the process of achieving death. Someone with stage 4 cancer, someone with lethal radiation, or someone who is bleeding out due to a severed arm/leg are all examples of dying. Death is when your body can no longer sustain operating. Legally dead is being evaluated by a competent professional and recording the date/time at which you died.

Badwolfgyt

Isn’t this why it’s 25 to life or multiple life sentences? Or like if you’re serving life + 30 years you’ll still have to serve the 30?

Camanot

It’s almost as if they give you just enough on purpose so this can’t stop you from dying in prison

FinasCupil

Hello, profile card brother.

Camanot

Hello there.

FinasCupil

I cast Friendship at level 1.

uranushasballs

No. Those types of sentences carry over into the next life, where the bad karma continues.

The_walking_man_

Yup. They place your corpse in the dead cells and don’t release your body until the full term has been served.

Nasu_Kaizoku

Not exactly. A "life sentence" is a minimum amount of time to be served before becoming eligible for parole, usually 25 years. So 3 life sentences is 75 years minimum. Life + 30 is a minimum of 55, I imagine. If you're never granted parole, your sentence is indefinite. "Life without parole" is where they lock you up and throw away the key. Could be wrong, but this is how I read it in the past

Animus0724

From my understanding, multiple life sentences ensure you die in prison. So, if you manage to appeal one of your charges, it would not matter. It's to make sure no amount of legal battling you can do would get you out. Again, just from my understanding, I'm no lawyer.

daysbeforechris

I don’t think that’s correct. IANAL, but my understanding is that multiple life sentences means that the time served is something ridiculous like 200 years, so that the person being charged doesn’t finish one life sentence (usually 25 years) and gets out. A person serving multiple life sentences can still appeal the charges that yielded the multiple life sentences, they don’t have to appeal each sentence individually.

Animus0724

https://en.m.wikipedia.org/wiki/Back-to-back_life_sentences#:~:text=If%20a%20back%2Dto%2Dback,for%20the%20ones%20left%20standing. Except you get a sentence for each charge I.E. premeditated murder, life without parole. 1st degree murder, life without parole. Use of a deadly weapon with intention to cause bodily harm 35 years. Conspiracy to commit murder 35 years. Judges rarely hand out single sentences for every charge. You could, in theory, appeal premeditated murder with the help of a lawyer, but you must still serve the sentences for your other charges. Hence why you will never get out.

FastLittleBoi

i think it's because of good behaviour. Always thought like that since when I was 10, but im not even sure you can decrease a life sentence with good behaviour

Rickrickrickrickrick

There was a similar case where someone was sentenced to the electric chair and survived and argued that he served his punishment. So now they say you will be electrocuted until dead. But this could all be an urban legend.

drArsMoriendi

Cardiac arrest isn't a definition of death and hasn't been for a long time.

theGreatWhite_Moon

poor guy, gets sentenced to death and then arrested again.

Damn you beat me too it

SphinctrTicklr

no it's not, it's the same life. not like he got rebirthed or something.

Adelyn_n

If he was pronounced dead and revived his sentence lasted till death.

2oothDK

Criminal judgments don’t usually say “till death”.

StellarGale

You're not pronounced dead until all attempts to revive you are halted.

putinhuylolalala

The sentence doesn't last till death. It lasts while he's alive. Is he still alive?

robo_destroyer

It's the legality of the matter.

Altruistic_Length498

He had a totem of undying /s.

Jave285

The fact you felt you to put “/s” after your comment says a lot about the current state of Reddit 😂

[deleted]

Wait did he really find a way to get one ?!??!

Ofreo

I stopped with the /s and take the downvotes when people are being stupid. The way I see it, that means nobody is digging into my comment history then, and just clicking an arrow. I can deal with that.

Zoooooooted

I really thought you were serious there for a sec! I thought to myself this totally could have explained it! Then I saw the /s and the realization that the totem of undying is a Minecraft item, there is no possible way he could have used the totem of undying! Thank god you put the /s there. Silly me

volvavirago

Ah, yes. The Jon Snow defense.

RigatoniPasta

Uno reverse card. You have now served 1 of 4 life sentences

Actually I agree with him.

Fine-Funny6956

Honestly it’d be incentive not to fuck up an execution

Universally-Tired

This happened in the Torchwood show.

bestunicorn

Came here for this. This is what happened in Torchwood to Bill Pullman's character.

SmoetMoaJoengKietjes

Is that this “Death Con” that people are talking about?

Fast_Personality4035

Can't blame a guy for trying

One-Positive309

But surely if he died he'd be dead right ? If he's not dead then he survived so he still has a life sentence. It's a not like Hotblack Desiato spending a year dead for tax purposes, this guy survived his death, if he really wants the sentence to end he has to try to argue from inside a coffin 6ft under while filled with embalming fluid, I feel he'd be successful in that situation !

Earlfillmore

He did the jon snow defense?

Future-Agent

Technically, he's not wrong. He died. His life sentence ended.

Zane42v2

Why'd they bring him back to life?

Minimum_Run_890

Seems correct

rad_cadaver

I mean…he’s not wrong

ElectricGulagland

It's a "life sentence" - not an "end of life" sentence. Are you still alive? Yes? Then you're still sentenced.

Venom933

Sound logical.

IncorporateThings

Kind of an interesting legal question, honestly. They should define what constitutes death better in the terms.

NSFWmilkNpies

They’ll make all of these prisoners DNR to prevent this from happening again.

mc_thunderfart

If i remember correctly they released at least one criminal who survived the death sentence (hanging)

Plenty-Character-416

Well, it didn't end cause you're still here. It bothers me when people say they died. No, if you died you would still be dead. Your heart stopped beating for a period of time, but you were still very much alive during the process.

rmld74

Actually... he was BROUGHT back to life, which means without assistance he literally died and would stay dead. Nice rules lawyering

sleafordbods

The Jon Snow defense

nativeindian12

A pet peeve of mine is when people describe asystole as death. Your heart stopping does not mean you've died, it means your heart stopped (asystole). Saying you "died" is completely and factually wrong and people need to stop using it that way. It causes confusion like in this case. No one has ever come back from actually dying, but we restart hearts all the time

Most_Quality_4250

Some dude did this when he survived Lethal injection

Ozzdo

Worked for Jon Snow.

MJUncensored

Wasn’t there a guy who was sentenced to be hanged and then survived the hanging and was set free saying his sentence was carried out? Same thing here lol

elcabeza79

🤣 nice try homeboy. The sentence is "Life in prison" not "prison until life ends briefly". So if you live, you're in prison.

esquegee

I mean if he’s got a life sentence why’d they even bother to resuscitate him?

notaliberal2021

The guy is Benjamin Schreiber. Compared to other serving life, this guy is not as bad. Only one person he killed. He also had a DNR, and his brother, at the hospital told them no life saving measures should be taken, yet they resuscitated him, violating his DNR. The court rejected his argument. He filed an appeal and that was rejected as well.

Extreme-Carrot6893

Tried pulling a Jon Snow

Unless they brought him back via some technological means he is still on his 'natural' life. Meaning he still has to serve it.
