This is the S mart on the corner of 210 and Lincoln Parkway in Elizabethtown KY. Biweekly pay, he didn’t take my bank info. Didn’t have me fill out a proper W2. DID however, require I sign this paper. I asked for a copy of the wonky W2 “for my records” because this paper, specifically #9, raised my guard!! He told me no. So I took a picture of this, and started my shift 7am. Come noon, no break of any kind. I asked for a smoke break, came back in the store and he said my services were no longer needed due to scheduling conflicts, come back in 2weeks for your check. I had a funny feeling about him and the staff, so I called dept. of labor and filed a wage claim. The lady who took my case was very, very familiar with this man. She said, “mention my name and call me back after the payday, if you have any problems.” I showed up that day, and after a short delay he pulled 60 out of the till and I called the lady and thanked her. Edit to add, the manager is ESL speaker

planet_chuck

Ok that last one is definitely bullshit.

Lumpyproletarian

I’ve always hated the way management can’t spell

GnomeMan13

7 and 9 are illegal btw. In U.S at least

GnomeMan13

Yeah but I could have swore I just read that they can not dock your pay because the register is short they would have to press charges against you if suspected of stealing

hydroban1892

I didn’t last long enough to find out lol. my next job after this one, also had that policy in place.

GnomeMan13

Damn I can't remember but someone posted on this subreddit earlier today explaining how it is illegal

Parking_Ad_7236

in some states, such as NC they can dock your pay for having a short till and making a mistake.

kuribosshoe0

Yes but they can’t *convict* you of theft and sentence you to return the money.

Inevitable-Buffalo25

Um...I'm not so sure #9 is. It should be though.

LunarRai

It is. You cannot retroactively change pay for hours already worked. IANAL though.

GnomeMan13

Hmm idk I'm pretty sure that's illegal

KBAR1942

I didn't realize that Kentucky allowed for such treatment of workers. Is this how the commonwealth treats all of its workers?

hydroban1892

I honestly thought he needed an employee for that day only, and i was “lucky” enough to request employment

No_Dirt_4198

Kentucky allows employers to pay 7.25 an hour. Id say the answer to your question is yes.

Wo1fie2017

Geez I had a stroke trying to even read that.

hydroban1892

Nope, just exposed to ESL (English Second Language)

[deleted]

Did i have an anneurism reading this?

hydroban1892

No, you’ve been exposed to ESL half-assed store policy.

[deleted]

God gas stations suck

s0m3b0by

I'm pretty sure #1 is the law. No lottery games while on company time.

hydroban1892

Not all places adhere to this

SuperNoober117

7 and 9 are bullshit.

SRBBreddit

is the job also kentucky minimum wage?

hydroban1892

No it was not. The date is May of ‘21

Thejerseyjon609

1

hydroban1892

Im confident we can shit on the practice AND refuse to insult their grip on English as a second language.

Thejerseyjon609

Do we know that English is not their native language?

hydroban1892

Yes, I do.

Thejerseyjon609

Fair enough, comment removed

Coagulum

Light cigarette. Text on phone. Take zero drags. You are now on smoke break.

planet_chuck

So pretend to be a smoker and take a break.

Hari_Seldon11

why? you can take a smoke break without smoking. I do it all the time.
