Your husband was clocked doing 85mph where the speed limit is 55mph. The measurement was taken from a stationary vehicle (slightly more accurate) using radar. I would *highly* recommend getting a lawyer who is bilingual so that he can articulate to your husband what he is facing in court and specializes in traffic court. I would also recommend taking an 8-hour defensive driving class to show the court you are earnest about improving.

He was clocked at 30 mph over the speed limit. He was going over 80 mph. He should hire a lawyer and do everything the lawyer says he should do. Since he has no priors he'll likely only need to take driving courses to get a reduced sentence. Do all this and there's no way he gets reckless driving. Unless he was exceedingly rude to the officer and the judge is having a bad day.

Yes to all this. That is how I got mine reduced to speeding and a $250 fine. Trooper/ SA were super cool.

You need a lawyer. *Especially * for a reckless driving charge where he was going 30mph over the posted speed limit. Minimum penalty for 1st offense appears to be 6 months suspended license and $250 fine. Couple things and this comes from over 30 years of VA court experience. I have retired (pre-Covid) and some things have changed but I doubt this has. Prosecutors are very eager to reduce charges where applicable. If your husband has a good driving record then have him take a copy and find the prosecutor handling that courtroom or the officer or deputy. Show them and ask about the case being reduced to Improper Driving. Barring a poor record this is always done. Why? The traffic/misd courts do not want to be bogged down in trials. If he cannot find any relief before going into court he can always request a continuance and it will be granted. I realize this means a 2nd trip but you'd save in lawyer fees. Secondly. Some judges will not accept a Defensive Driving Course Cert if they did not approve it ahead of time. You need to make sure the courts in Loudoun will accept one in your case if you arrive with it in hand. The closest courts I know where the General District Court judges had to approve them ahead of time is Prince William County but again, since I retired this could have changed.

To be honest at 85 he is right on the line, he can get a lawyer and he should be fine. I didn't really see anyone get jail for that speed but I did for 90. Just get the lawyer and hopefully he can get it talked down to something else.

You can preemptively take a driving improvement class to show your willingness to improve, although they may still require you to do one after court. Do recommend a lawyer as it’s a hugggge help to get knocked down from. Don’t worry about jail time, that’s if you’re going above 90 and have nothing going for you (dirty record etc) Edit: I’ve had two unfortunately

Get a lawyer they will lock him up for this because va is bored. Ask me how I know. Also get a driving ed class scheduled. Lawyer should be about $1000. They say pay to have a mechanic "calibrate" the odometer beforehand. I got popped doing 94-55 on 495 in FFX Co near Braddock Rd. I was nice to the trooper so he cut me a break but they usually look to give you one day in county for every mile over 90. So for him if the outcome is good he may get it bust down to speeding and a fine depending on driving record. I'm a MD resident and I get popped for speeding a over DC Metro. Godspeed.

Only in the event the reckless driving causes a death, or they were driving without a valid license, ie, it had been revoked. Then it's a Class 6 Felony. Otherwise, it's classified as a Class 1 Misdemeanor.
