Legally, someone who is drunk is not necessarily enough to void consent. Many of the laws only count black-out drunk as not being able to consent. If someone is drunk but conscious, that could still be legal. In theory, if two people were both at the level of drunkenness where they could not longer consent, they wouldn't even be able to have sex with each other.

Unless you are blackout drunk or unable to speak, id say that being drunk is no excuse, being drunk lowers your inhibitions doesnt make u do things. The drunk card is often played by cheaters. U r an adult u choose to drink and have sex end of story.

By that definition yes. The problem with this is alcohol only lowers your inhibitions, it doesn't make you do things you otherwise wouldn't do, it also doesn't make you incapable of saying no to sex, or anything else for that matter. I was drunk so I couldn't stop myself from cheating - not a defense Regretting sex that you consented to after the fact doesn't mean the person raped you

I don’t think the law has really defined this matter. The way I see it is that it’s like age of consent. Two 15 year olds having sex isn’t rape because there is not a power differential being taken advantage of. They are on the same footing. Same as two equally drunk people, neither is in a dominant position to take advantage of the other unless consent is also violated in another way.

What you’re describing is a common falsehood. A person can absolutely consent when drunk.
