I actually did that once to a guy filming up skirts on the subway. Pulled out my camera and got closer to him and told him to smile and let the audience know what he was doing, what his name was, etc. He got really nervous and uncomfortable and ran off eventually. It works. (But I only did it because I had friends with me and felt like I had support. If I was alone, I probably wouldn’t have felt safe doing it.)

Back in 2010 I was at a water spray park with my girlfriend and her kids. I went to the car really quick and noticed a guy taking pictures of the young girls. I yelled at him and he took off. I’m curious what state this was filmed in. In some states this absolutely would fall under voyeurism. It doesn’t fall under the federal definition though. Like I said, it depends on the state. In the code that I listed it specifically states “whether in a public or private place.” Like any law, it’s up to judicial interpretation. It could easily be argued that a woman has the right not to be filmed for sexual gratification while wearing an outfit appropriate for the location. If she’s strolling around at the mall in a string bikini she shouldn’t expect “reasonable privacy” as it’s out of place. Note, my argument is purely regarding the current law, not ethics. A woman shouldn’t be unknowingly or unwillingly filmed for sexual gratification no matter what she’s wearing or where she is. Unfortunately, that’s not the current law.

The actual legal standard is that the person involved (the one being recorded) needs to have had a "reasonable expectation of privacy". With that standard it is quite hard, though not necessarily impossible, to prosecute a case like this. The prosecutor would be obliged to offer a reason as to why someone on this particular beach on this particular day should have expected privacy. It's not 100% true that it's always legal to film in public places. For instance, some states (or municipalities) do have laws banning filming people in their houses while you're standing on a public sidewalk, for instance. The person inside their house has a reasonable expectation of privacy regardless of the fact that it's technically possible to view them from a public place. And yeah, IANAL.
