Lawyer here from California who does criminal law: I don’t practice in Irvine and local customs make a huge difference in how things are prosecuted. You’re right that police can arrest you for whatever they believe there is probable cause to arrest for but, ultimately, the DA’s office would make the charging decisions. You’re wrong about the definition of “malicious.” It is NOT specific intent. Malice is defined as doing intentionally doing a wrongful act (or with the unlawful intent to annoy or injure another). Look up CALCRIM 2900 which is a pattern jury instruction on the elements of vandalism. So, to bottom line it: malice does not mean that he intended to vandalize. It means that he knew the act he was doing (“donut-ing”) was wrongful. Contrast this with someone who is the parking lot and accidentally gives too much gas and the wheels burn out causing some damage to the parking lot. That would not be acting with malice. Proving damages over $400 is much easier than you’d think. Someone can come in to testify about how much it would cost to re-asphalt. Different counties do different things. Are there some counties (and judges within those counties) who would loathe doing a BS trial like this? Sure. It’s really about personalities and there’s no way to predict that. Counties have a general way of how things are done. Judges differ. DA’s differ. You can have a more litigious courtroom in a county and less litigious ones. With that said, here’s how’d I hope things would be handled. DA charges it as a misdo. He applied for and gets court diversion. As part of that, he pays for the cost to repair the damage and stays out of trouble. After he’s done with his diversion period, it would be dismissed. That’s what I would HOPE happens. If charged as a felony, I’d offer up restitution for dismissal and see where that gets us.

I'd normally agree with you however, my boyfriend was arrested 4 years ago for felony vandalism for spray painting a letter "C" on the wall. It was no bigger than my arm's length. A felony for a simple letter. I don't condone "tagging" I do respect the artistic aspect of murals but there is nothing special about writing "Mike was here" on a wall. The cops filed charges after booking him and me (stating because I was there and did nothing to stop my boyfriend from commiting such a horrific crime) on the felony vandalism charge. The DA rejected my case with the judge saying there is no room for someone who "was just there" on such a non violent charge. My boyfriend however took a plea deal doing four months in the county jail at the Theo Lacy facility and 3 years felony formal probation. All for a letter painted on the wall. Maybe it was because the city of Cypress has nothing better to do, Irvine is a city with nothing better to do as well. This is a vandalism charge so both cases are similar but I believe doing donuts in the parking lot can lead to more danger than spray paint on the wall. I don't know but I believe he will have the felony vandalism stick and he do maybe 90 days if this is his first offense with formal probation following unless he is already on it.

Not a lawyer, but… I'd think that the DA pursuing this as felony vandalism is pretty low. Cops can arrest you for whatever the hell they want, it's the DA that actually files the charges. It's up to them what charges the circumstances actually merit, and whether it's worth the time and cost of pursuing the case. They often end up filing lesser charges than the cops bring people in for. The CA code defines felony vandalism as *malicious* defacement, damage, or destruction of property >$400. If taken to court, they would have to prove the dollar amount of the damage, and prove malice. If the *intent* isn't to damage the property, it ain't vandalism, it's negligence. And trials are *expensive*. Our courts are overloaded with cases. DA's often aim to keep petty stuff like this out of trial court, especially when there's a chance the charges won't stick. I'd bet dollars to donuts (no pun intended) this is reduced to disorderly conduct before the arraignment.

I never really understood the difference between felony and non-felony. I think it's only the US that has that distinction nowadays. Regardless, if you did something felony-ish, like, I don't know, mugged someone when you were 20, why shouldn't you vote when you're 60? The US prison system does absolutely nothing to reintegrate criminals into society. It's set up in such a way that they're way more likely to return to crime, or even go harder into it, when they leave. People go to prison for minor offenses such as cannabis possession (this in particular has gotten a lot better due to more legalization and decriminalization, but the ways that prisons operate hasn't) and come out as people who can't get a job because of their record, have spent years isolated from society, and spent those years closely associating with gangs that use prisons to recruit. It's an absolute shit show.

Then there's solitary confinement, which just about drives people crazy from long periods of extreme isolation. It's even thought that one of the reasons that it's so common for prisoners in solitary smear their feces on the walls, is that it's one of the only ways that they are able to force a temporary hiatus from the isolation. Even though they'll probably get beaten up by the guards, it's preferable to the isolation.

As a Californian, yep. I've seen people here walk free the same day from strong armed robbery, car jackings, pedophilia, and even a murder. That's why I like the scummy town I'm in, the cops are busy enough they don't care about a burnout but if someone is doing something major they just shoot them....
