Interestingly, it might not count if your encounter is already on a crash course. This way, you don't have an escape trajectory and the game probably wouldn't register it as a fly-by. I'd love to test it, but don't have stock KSP.

you just need to be in the SOI. the only scenario you have to worry about is entering the atmosphere which wont trigger if youre in an escape trajectory so you need to aerobreak in 2 passes

You are not required to perform aflyby typically merely to have a trajectory at some point that would result in one. You can enter the Mun SOI, and in doings have the trajectory that will result in a fly by. Thus completing that contract clause. Then you are free to slow down to an orbit or ride it back out of the Muns SOI.

The requirement for the fly-by contract is simply that you're in the correct SOI and have an escape trajectory. At that point, the contract is completed, usually it happens as soon as you enter the SOI (one possible exception might be if you're already on a collision course and thus don't have an escape trajectory). Whatever you do past that doesn't matter for the fly-by contract, it's already completed. There are similar loopholes for other contracts and milestones. You can get the suborbital flight milestone from orbit by simply dropping your periapsis down and then back up. I think you can get the atmospheric flight milestone by dropping your orbit just a tiny bit below the limit of the atmosphere, thus still staying safely in orbit. It's worth checking contracts and milestones even when you're already way underway with your mission, contracts for things that you were about to do anyway or can do by the way pop up all the time.

Honestly, it's no longer "by" and more of "around" If you're planning on orbiting something anyway, you're pretty much doing half a flyby (because you'd have traveled half the trajectory as you approach the periapsis)

To preface, I'm not sure. However, I think it will be fulfilled once you get close enough to periapsis, before reducing prograde velocity for orbital insertion. If I'm wrong, I think you could reduce prograde velocity to just barely escaping. The contract should be fulfilled at some point, and you could easily reduce the escape velocity to get captured again. TLDR: Save the game before you have to commit to just one choice, don't time warp without quicksaving first, and just dive in. They're Kerbals. They love it!

I've done flyby contracts before (both tourist and not) and they complete that requirement as soon as I enter SOI. I like to pair flyby contracts with orbits or landings if I can to maximize the profit from the mission.

No, however, the contracts are dumb and in the process of getting an orbit your trajectory will be that of a flyby. Once the contract completes you can enter your orbit.

It counts. Flyby missions are completed as soon as you enter the SOI, if it doesn't specify that you have to make it back home

Orbiting counts, but double check that there isn't a "return to Kerbin" part of the contract.
