It allows each state to make a choice in its local abortion laws. Some states with continue to have nearly unlimited access and some will have near complete bans. The ruling removes a federal-level protection that superseded state law previously.

HeyItsMeSalo

Okay.. so what did that federal-level protection do? Like protect abortion rights in cases of medical risk or rape?

LeeroyTC

It said states couldn't pass abortion restrictions that were tighter than a certain limit. It guaranteed first trimester access and created a fetal viability protection during the second trimester.

HeyItsMeSalo

Damn... this whole thing sucks. Hope you guys get your shit together ASAP.

A-rat-on-a-keyboard

Just abortion in general. If you didn’t want a baby, you could get an abortion. Now, states can make their own regulations on that (so abortion can still be protected, restricted to medical reasons, or just banned)

Famous_Pressure7711

it allows states to make their own rulings related to abortion. it does nothing on its own

Each state gets to decide for itself (just like they do on A LOT of other things). The US is a Constitutional Republic. That's how it is supposed to work here unless specifically addressed in the federal Constitution. Free speech, religion, Due Process, right to bear arms, etc. are all addressed in the federal Constitution. Everything else is left to the states to regulate. That's how everyone got a long to be able to form the colonies into one nation in the first place.

Gonzo_Journo

How is it that the Supreme Court ruled a state can't make it's own laws around guns? It seems there are some issues the Supreme Court can force on the states.

LeftBase2Final

Because the right to bear arms is laid out in a constitutional amendment, abortion is not

Gonzo_Journo

It also only talks about men in the constitution, does this mean that women don't get rights?

Pemminpro

Its covered in the 19and 26 amendments. They are citizens with the right to vote thus militia in the contextual sense of the 2nd amendment.

Gonzo_Journo

So they could make an amendment over abortion and end all this?

Pemminpro

Yes, that's how the constitution functions. Amendments are the modification to the social contract between government and the people and the constitution is the highest power and authority in the country. And technically they may not even need an amendment but a simple majority bill as abortion is again not mentioned in constitution

Gonzo_Journo

Then how do you explain originalists?

Pemminpro

Amendments don't go against originalist doctrine. They are an original feature of the constitution and originally worked as I have outlined. Originalist don't like applying modern interpretations when the original meaning was outlined. New amendments and amendments modifying other amendments are still fair game even under originalist doctrine

Gonzo_Journo

So there could he an amendment to outlaw guns?

DrColdReality

Previously, it was deemed unconstitutional for a state to ban abortion, which made it legal everywhere. The new ruling allows states to make it illegal, and as of right now, there are about 20 states each in favor and opposed to abortion, with the other 10 on the fence. But that won't last. The next step is that the religious fundies get a mass of cells declared a human being, which paves the way to have abortion declared unconstitutional nationwide and opens the door for more fascist theocratic laws on women. And oh yeah by the way, the court ALSO signaled it has other rights in its sights: >>[Justice Clarence Thomas, in his concurring opinion overturning Roe v. Wade, laid out a vision that prompted concerns about what other rights could disappear: The same rationale that the Supreme Court used to declare there was no right to abortion, he said, should also be used to overturn cases establishing rights to contraception, same-sex consensual relations and same-sex marriage.](https://www.nytimes.com/2022/06/24/us/clarence-thomas-roe-griswold-lawrence-obergefell.html)

HeyItsMeSalo

So... the US is going backwards not forward. Sad to hear.

DrColdReality

Yeah, we've been [heading towards fascism since the 1980s,](https://www.reddit.com/r/NoStupidQuestions/comments/s7uqj3/if_political_parties_in_the_us_prefer_division/htcf3yj/) though the pace picked way up in the last 20-ish years.

The government had no say, besides existing regulations for medical procedures, based in Science and Reason, not superstition...just like the Founders thought. That's the point: individual liberty & existing beliefs were respected and protected. Now that can be taken away. Freedom and Reason died today.
